I oppose the Office of Personnel Management’s proposed government-wide nondisclosure agreement for federal employees (Docket OPM-2026-0100).

As a federal employee at the Department of Veterans Affairs, I am deeply concerned that this policy would undermine existing whistleblower protections and chill constitutionally protected speech. Federal employees already have legal obligations to protect genuinely classified and sensitive information. A broad, mandatory NDA goes far beyond those existing obligations and would create confusion about what employees may lawfully report to Congress, inspectors general, and the press.

The Whistleblower Protection Act exists precisely to protect federal employees who report waste, fraud, abuse, and violations of law. Requiring employees to sign an NDA that restricts disclosure of “non-public, confidential, or proprietary information” — without clearly defining those terms — would deter employees from exercising rights the law expressly guarantees.

I urge OPM to withdraw this proposal. If OPM believes additional guidance on information-handling obligations is needed, it should be provided through education and training, not through enforceable agreements that threaten employees’ livelihoods for exercising their legal rights.
